1. Definitions

In these terms:

  • "We", "us", "our" means Sew Gutsy Ltd (company number 15545511), a company registered in England and Wales, trading as Lurking Mum Quilts.

  • "You", "client" means the person who has booked or is enquiring about our services.

  • "Quilt top" means the pieced or otherwise constructed top layer of fabric that you submit to us for quilting.

  • "Finished item" means your quilt top after we have quilted it, ready for you to bind or finish as you choose.

  • "Service" means the edge-to-edge longarm quilting we provide, plus any optional extras such as backing fabric or wadding if you have asked us to source and supply those.

2. How to book

You start by sending us an enquiry with details about your quilt. We will provide a quote and an estimated turnaround time.

A contract is formed when you confirm the booking and we confirm it back to you in writing. Email confirmation counts as written confirmation.

No booking is confirmed until we have confirmed it. If you send your quilt before we have confirmed the booking, you are doing so at your own risk.

3. Pricing and payment

Pricing is calculated per project based on the size of your quilt and any optional extras you have requested, such as backing fabric or wadding.

Full payment is due on completion, before we return the finished item to you.

We accept payment by PayPal, BACS bank transfer, and cash (for local drop-off only). Payment details will be included on the invoice we send via FreeAgent.

All prices are shown in GBP. We are not currently registered for VAT, so VAT is not charged.

If the scope changes after booking - for example, if the quilt is larger than you described or additional materials are needed - we will notify you before proceeding and update the agreed price accordingly. You will have the opportunity to confirm the new price before we continue.

4. Submitting your quilt

You are responsible for preparing your quilt top properly before you send it to us. That means: pressed, trimmed, loose threads removed, and squared up as best you can.

If you are posting your quilt, you are responsible for packaging it securely. We accept no liability for damage that occurs in transit to us.

We will confirm when we receive your quilt and let you know if we have any concerns before we start work.

5. Care and liability for the quilt

We will take reasonable care of every quilt submitted to us. We treat every item as the personal, handmade, irreplaceable object it is.

We are not liable for pre-existing damage, imperfections, or weaknesses in the quilt top that were not visible or disclosed at the time you submitted it.

Sew Gutsy Ltd holds public liability and professional indemnity insurance. In the unlikely event of loss or damage caused by us, our liability is limited to the lower of: (a) the value you declared at the time of booking, or (b) £10,000.

We do not accept liability for items lost in the postal system during return unless a tracked and insured Royal Mail or courier service has been used.

We strongly recommend that you insure high-value quilts in transit. If your quilt has significant sentimental or monetary value, please declare this at the time of booking.

6. Turnaround times

The turnaround time we provide at the time of booking is an estimate, not a guarantee.

We will communicate proactively if a delay arises.

We do not accept liability for losses arising from delays that are beyond our reasonable control, such as illness, Royal Mail delays, or equipment issues.

7. Cancellations

You may cancel your booking before we have begun work. If we have already sourced materials on your behalf (backing fabric or wadding), you will be charged for the material costs.

If work has already begun, you may be charged a partial fee reflecting the work completed so far. If work has been started and the quilt needs to off-loaded and re-loaded for reasons outside our service delivery, we may charge a partial or full fee for this.

We reserve the right to cancel a booking - for example, if a quilt is submitted in a condition we cannot work with safely. If we cancel, any amount you have paid will be refunded in full.

8. Returns

Finished items are returned by Royal Mail tracked 48-hour delivery unless you request an alternative method.

The cost of standard return postage (Royal Mail tracked 48) is included in the price you pay. If you prefer a different return method - such as courier delivery or local collection - that must be arranged in advance. If your preferred method costs more than the standard route, the additional cost will be added to your invoice.

We will keep finished items for a maximum of 90 days after notifying you that your quilt is ready. After that period, storage charges may apply, we may return the item to you at your cost or sell to recoup our costs.

9. Complaints

If you are unhappy with the finished item, please contact us within 14 days of receiving it. We will look at the issue fairly and try to find a resolution.

We are not able to unpick or re-do quilting that has been bound or washed after it has been returned to you.

10. Intellectual property

The pantograph designs we use for quilting may be third-party licensed designs. We hold appropriate licences for commercial use.

You are welcome to choose from our existing pantograph library. If we need to purchase a new pantograph design specifically for your quilt, we may pass some or all of that cost on to you. We will discuss this with you before making the purchase.

You retain ownership of your quilt top and finished item unless there is a breach of section 8.

We may photograph finished quilts for portfolio and marketing purposes unless you opt out at the time of booking.

11. Limitation of liability

Our total liability to you in connection with any service is capped at the total amount you paid for that service.

We are not liable for indirect, consequential, or economic losses.

Nothing in these terms limits our liability for death or personal injury caused by negligence, fraud, or anything else that cannot be excluded by law.

12. Governing law

These terms are governed by the law of England and Wales.

13. Changes to these terms

We may update these terms from time to time. The version in effect at the time you make a booking is the version that applies to that booking.

The following sections apply to all purchases of digital products from Sew Gutsy Ltd trading as Lurking Mum Quilts. They apply in addition to sections 1 to 13 above. Where there is any conflict between these sections and sections 1 to 13 in relation to a digital product purchase, these sections take precedence. Sections 3 to 8 of the main terms (pricing, submission, care and liability, turnaround, cancellations, and returns) do not apply to digital product purchases except where expressly stated below.

14. Scope

These sections cover the purchase of digital products, including downloadable PDF quilt patterns and digital pantograph designs sold by Sew Gutsy Ltd trading as Lurking Mum Quilts.

15. Additional definitions

For the purposes of these sections:

"Digital product" means any downloadable file sold by us, including PDF quilt patterns and digital pantograph designs.

"Download link" means the URL or access mechanism provided to you after purchase, through which the digital product can be accessed and saved.

"Licence" means the personal, non-exclusive, non-transferable right to use the digital product as set out in section 21 below.

16. Ordering and delivery

A contract for the purchase of a digital product is formed when we confirm your order by email following payment.

Your download link will be sent to the email address you provide at checkout. Delivery is considered to occur when that link is made available to you, regardless of when you choose to access it.

You are responsible for ensuring the email address you provide at checkout is accurate. We are not responsible for non-delivery resulting from an incorrect or inaccessible email address.

If you cannot find your download link, check your spam, junk, and promotions folders before contacting us. If you still cannot locate it, email us at hello@lurkingmum.com with your order number and the email address you used at checkout.

Download links may be subject to a validity period or a download limit. These details will be stated at the point of purchase. If you have difficulty accessing your purchase within the stated period, contact us and we will resolve it.

All prices are shown in GBP. We are not currently registered for VAT, so VAT is not charged on digital products.

17. Cancellation right and waiver

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have a 14-day right to cancel a purchase of digital content, provided the content has not yet been accessed.

Before purchasing a digital product, the following notice is displayed on the product page: "This is a digital download. It is available immediately after purchase. By completing your order you confirm you consent to immediate delivery and waive your 14-day right to cancel."

At checkout, you are required to confirm that you have read and agree to our Terms and Conditions before your order can be completed. These Terms and Conditions include this section. By ticking that box and completing your purchase, you give your prior express consent to immediate delivery of the digital content and acknowledge that you waive your 14-day right to cancel.

Where that confirmation has been given, you will not be entitled to cancel your purchase or receive a refund on the basis of the 14-day cancellation right once the download link has been accessed.

If you complete a purchase but do not access your download link, your 14-day right to cancel remains intact. To exercise it, contact us at hello@lurkingmum.com before accessing the download and we will confirm the cancellation and process a refund within 14 days.

18. Digital content quality

Under the Consumer Rights Act 2015, digital content we sell must be of satisfactory quality, fit for the purpose described, and as described at the point of sale.

We take reasonable care to ensure all digital products are accurate, complete, and free from errors.

We do not guarantee that digital products will be compatible with all devices, software, or operating systems. Any minimum technical requirements will be stated on the product page before you purchase.

19. Remedies for defective digital content

If a digital product you have purchased does not meet the quality requirements in section 18, you are entitled to a remedy under the Consumer Rights Act 2015.

We will first offer to repair or replace the defective digital product. If we cannot do so within a reasonable time and without significant inconvenience to you, you may be entitled to a full or partial refund.

To report a defective digital product, email us at hello@lurkingmum.com with your order number and a description of the issue. We will respond within 48 hours.

20. Refunds and exchanges

Subject to sections 17 and 19, refunds are not available on digital products once the download link has been accessed.

If you have purchased the same digital product more than once in error, contact us at hello@lurkingmum.com within 60 days of the duplicate purchase. Include your order number, the email address used at checkout, and the pattern you would like in exchange. We will exchange the duplicate for a digital product of equal value.

Where a refund is due under section 17 or section 19, we will process it to your original payment method within 14 days of confirming the refund is owed.

21. Licence

When you purchase a digital product, Sew Gutsy Ltd grants you a personal, non-exclusive, non-transferable licence to use it for personal, non-commercial purposes only.

Under this licence you may:

(a) Print the digital product for your own personal use as many times as you need.

(b) Make quilts or other textile items from the pattern for personal use, as gifts, or for charitable purposes.

Under this licence you may not:

(a) Reproduce, copy, share, distribute, resell, or make available the digital file or its contents to any third party, whether for payment or free of charge.

(b) Make and sell quilts or other items commercially using our patterns without a separate written commercial licence obtained from Sew Gutsy Ltd.

(c) Teach classes, workshops, or courses using our patterns without our prior written permission.

(d) Modify or adapt the digital product and present it as your own work.

22. Intellectual property

All digital products sold by Sew Gutsy Ltd are protected by copyright. All intellectual property rights in the content, instructions, diagrams, and visual elements of our digital products remain the property of Sew Gutsy Ltd.

The trade mark "Lurking Mum" belongs to Sew Gutsy Ltd. Purchasing a digital product does not grant you any right to use that mark.

Purchase of a digital product grants you the licence set out in section 21 only. No intellectual property rights are transferred to you.

23. Support, complaints, and statutory rights

If you have difficulty understanding the instructions in a digital product, email us at hello@lurkingmum.com. We will respond within 48 hours. If an instruction is found to be unclear or incorrect, we will issue a corrected version.

If you are not satisfied with a digital product purchase and the matter is not resolved under section 19, you may raise a complaint under section 9 of these terms.

Nothing in these sections affects any statutory rights you have as a consumer that cannot be excluded or limited by contract, including your rights under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
